    去年，张某在顺义区打工期间，多次伙同他人进行盗窃，共窃得笔记本电脑、电动自行车等物，总价值1.1万余元。被抓获后，张某协助公安机关抓获了同伙，属有立功表现。

    此案公诉到法院后，承办法官联系到张某的父亲，告知他如果能替张某向被害人退赔赃款,客车行驶途中起火19名乘客逃生(组图)，法院结合张某的立功表现，可考虑判其缓刑。但张父明确表示不同意退赔赃款，由于儿子不听劝告，现在他希望法院能帮助教育、改造张某，他作为父亲愿听从法院判决。

    经过审理，法院认为张某的行为已构成盗窃罪，且数额巨大。鉴于他犯罪时未满成年，有立功情节，依法对其减轻处罚。但考虑到他多次盗窃，主观恶性较大，且没有退赔给被害人造成的经济损失，因此决定对其逮捕,监听手机价格，，判处实刑。

    宣判后，张某服判未提出上诉，张父也表示尊重法院判决，并希望张某在服刑期间得到教育，今后走上正路。 ]]>
